Definitions

Company means Marshal Packers & Movers, its employees, agents, and approved sub-contractors. Customer means the individual or entity engaging the services. Goods means all items, property, vehicles, or consignments accepted for transportation or storage.

Governing law and jurisdiction

These terms are governed by the laws of Maharashtra, India. Courts in Mumbai, Maharashtra have exclusive jurisdiction unless a written agreement states otherwise.

Arbitration

Any dispute not resolved through mutual discussion within 30 days may be referred to a sole arbitrator appointed by mutual consent under the Arbitration and Conciliation Act, 1996. The seat of arbitration is Mumbai.

Force majeure

Marshal is not liable for delay or failure caused by events beyond reasonable control, including weather, floods, fire, strikes, riots, road closures, government action, pandemic restrictions, or port and checkpoint disruption.

Privacy and data

Customer information is used for booking, service delivery, billing, insurance, and legally required documentation. Information may be shared with direct service partners only where required to complete the service.

Prohibited goods

Currency, jewellery, precious metals, firearms, explosives, hazardous goods, illegal goods, perishables unless agreed, live animals, plants, drugs, and goods the customer has no legal right to transport are not accepted.

Service-wise terms

Cancellation

7+ days before move: 90% refund of advance paid. 3 to 7 days: 60% refund. Within 3 days: 30% refund. Once loading begins: no refund.

Liability

Transit times are estimates, not guarantees. Delay due to road, weather, regulatory, or force majeure factors is not grounds for compensation. Insurance claims follow policy terms.

Storage and warehousing

Payment

Storage is billed as agreed in the storage quote. Minimum period and retrieval charges are shown before booking.

Cancellation

No refund is provided for unused days in a billing cycle unless a written agreement says otherwise.

Liability

Goods must be inventoried and declared. Cash, jewellery, documents, perishables, plants, animals, hazardous goods, and illegal items are not accepted. Insurance is recommended.

Commercial shifting

Payment

Commercial moves generally require survey-based pricing. Payment milestones may include advance, loading-day payment, and post-delivery balance as agreed in writing.

Cancellation

7+ days before move: 80% refund. 3 to 7 days: 40% refund. Within 72 hours: advance forfeited unless the signed agreement states otherwise.

Liability

Marshal handles physical movement of assets. Data loss, business interruption, IT configuration, civil work, and missing access permissions are excluded unless separately agreed.

PTL, FTL, and logistics

Payment

Freight payment terms depend on shipment type, route, chargeable weight, documentation, and partner requirements.

Cancellation

Before pickup: 100% refund where no partner cost is incurred. After pickup: no refund; return movement, if possible, is at customer cost.

Liability

Claims must be filed within 7 days of delivery or expected delivery for lost consignments, with receipt, consignment note, photos, and claim form. Liability is limited to Rs. 500 per kg unless insured.

International moving interest

Payment

International relocation is currently an interest-registration and planning service unless a separate written quote confirms live service availability.

Cancellation

Before origin dispatch, partner and documentation costs may be non-refundable. After dispatch, refund is not guaranteed and return movement may involve significant customer cost.

Liability

Marine or air cargo insurance is strongly recommended. Uninsured goods move at customer risk and claims follow insurer or partner terms.

Insurance and claims

Transit insurance is optional but strongly recommended for high-value goods, vehicles, electronics, furniture, commercial assets, and intercity moves.

Declared value must be provided before booking. Undeclared goods, pre-existing damage, inherent defects, poor internal condition, and excluded items may not be covered.

Insurance claims require timely notice, photos, invoices or value proof where available, booking details, and insurer documentation.

Insurance coverage is governed by policy terms. Marshal helps coordinate documentation but does not override insurer exclusions.
